Caddie Corner Participant Waiver

This participant waiver is part of the Caddie Corner General Facility Terms, Bay Rental Policy & Participant Waiver. The sections below are reproduced from those Terms without change. The full Terms are at /terms.
2. ASSUMPTION OF RISK
PLEASE READ THIS SECTION CAREFULLY.
Golf, simulator golf, racing simulators, darts, and other recreational activities involve inherent and other risks of personal injury and property damage.
These risks may include, without limitation:
- Being struck by a golf club
- Being struck by a golf ball
- Golf club heads or other equipment becoming detached or breaking
- Golf balls rebounding or ricocheting
- Slipping, tripping, or falling
- Contact with walls, screens, flooring, mats, furniture, equipment, or other persons
- Strains, sprains, muscle injuries, or other injuries caused by swinging a golf club
- Injuries resulting from improper use of simulators or other equipment
- Injuries caused by another participant or guest
- Equipment malfunction
- Risks associated with racing simulator seats, steering wheels, pedals, motion, or force-feedback systems
- Risks associated with thrown darts
- Risks associated with participating in the facility while employees are not present
By participating in activities or entering activity areas, you KNOWINGLY AND VOLUNTARILY ASSUME ALL INHERENT AND REASONABLY FORESEEABLE RISKS ASSOCIATED WITH THOSE ACTIVITIES, whether known or unknown.
You are responsible for determining whether you are physically capable of participating safely.
3. RELEASE AND WAIVER OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY OHIO LAW, YOU AGREE TO RELEASE, WAIVE, AND HOLD HARMLESS CADDIE CORNER AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LANDLORDS, AFFILIATES, SUCCESSORS, AND ASSIGNS FROM CLAIMS FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM OR RELATED TO YOUR PARTICIPATION IN CADDIE CORNER ACTIVITIES OR USE OF THE FACILITY.
THIS RELEASE IS INTENDED TO INCLUDE CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF CADDIE CORNER OR OTHER RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
Nothing in these Terms is intended to release liability that cannot legally be released under applicable law, including liability arising from willful or wanton misconduct where such liability cannot legally be waived.
27. MINORS
Parents and legal guardians are responsible for supervising minors and determining whether participation is appropriate.
Where a parent or legal guardian accepts these Terms for a minor, the parent or guardian represents that he or she has authority to do so and agrees to the Terms on behalf of the minor to the fullest extent permitted by Ohio law.
Guests of all ages are welcome during staffed hours. During staffed hours, anyone under age 18 must be accompanied and supervised by a parent, legal guardian, or another responsible adult. Racing simulators are restricted to participants age 12 or older. No additional general minimum age is imposed for golf or darts, but all participants must be able to use the equipment safely and comply with posted equipment restrictions. All after-hours access, for Tier 2 members and their guests, is limited to persons age 18 or older. Adult supervision does not replace any required parent/legal-guardian waiver or consent.
CUSTOMER ACKNOWLEDGMENT
BY AFFIRMATIVELY ACCEPTING THESE TERMS, I ACKNOWLEDGE THAT I HAVE HAD AN OPPORTUNITY TO READ AND RETAIN THEM. MY PARTICIPANT WAIVER APPLIES TO MY OWN PARTICIPATION, NOT TO OTHER ADULTS FOR WHOM I BOOK OR PAY.
I UNDERSTAND THAT PARTICIPATING IN GOLF, RACING, DARTS, AND OTHER ACTIVITIES INVOLVES RISK OF PERSONAL INJURY AND PROPERTY DAMAGE.
I VOLUNTARILY ASSUME THOSE RISKS.
I SPECIFICALLY UNDERSTAND AND AGREE THAT CADDIE CORNER IS NOT RESPONSIBLE FOR DAMAGE TO MY PERSONAL GOLF CLUBS OR OTHER EQUIPMENT TO THE FULLEST EXTENT PERMITTED BY LAW.
IF I AM AN ELIGIBLE AFTER-HOURS PARTICIPANT, I UNDERSTAND THAT NO CADDIE CORNER EMPLOYEE MAY BE PRESENT AND I ACCEPT THE ADDITIONAL RISKS ASSOCIATED WITH UNSUPERVISED USE TO THE EXTENT PERMITTED BY LAW.
I HAVE READ AND AGREE TO THE RELEASE AND WAIVER OF LIABILITY CONTAINED ABOVE.
